These Terms of Service govern your use of the Exoticool website, online store, products and related services operated by Exoticool Merch LLC, doing business as Exoticool.

By accessing our website, creating an account or placing an order, you agree to these Terms and the policies incorporated into them, including our Privacy Policy, Shipping Policy and Refund Policy.

1. About Exoticool

Exoticool is an independent streetwear and lifestyle brand intended for customers age 18 and older.

Our current products include original graphic apparel manufactured through a made-to-order fulfillment model. Production begins after an order is submitted to a fulfillment partner.

2. Age and Eligibility

You must be at least 18 years old and legally able to enter into a binding agreement to use our services or place an order.

By using our services, you represent that:

You are at least 18 years old.
The information you provide is complete and accurate.
You are authorized to use the payment method submitted at checkout.
Your use of the services complies with applicable law.

3. Made-to-Order Products

Exoticool products are manufactured after purchase through production and fulfillment partners.

Product colors may appear differently depending on screen settings, lighting and manufacturing materials. Minor variations in print placement, color or appearance can occur through the printing process and are not generally considered defects.

This does not limit your ability to report an item that arrives damaged, defective, misprinted, incorrect or significantly different from what you ordered. Those claims are handled under our Refund Policy.

4. Product Information and Sizing

We make reasonable efforts to display accurate product descriptions, images, materials, available sizes and prices.

Customers are responsible for reviewing product details and applicable size charts before ordering. Because items are made to order, we do not accept returns, exchanges or refunds for incorrectly selected sizes, colors, personal preferences or changes of mind.

Product photographs may include digital mockups, models, styled environments or close-up images intended to demonstrate the artwork and product appearance.

5. Orders and Acceptance

Submitting an order does not guarantee acceptance. We may decline or cancel an order because of:

Suspected fraud or unauthorized payment
Incorrect or incomplete customer information
Pricing or product-data errors
Product or fulfillment unavailability
Violation of these Terms
A legal or compliance requirement

If we cancel a paid order, we will issue a refund to the original payment method.

Customers must provide complete and accurate billing, shipping and contact information. Exoticool is not responsible for delays or delivery problems caused by inaccurate information supplied by the customer, except as required by law.

6. Pricing, Currency and Taxes

Prices are displayed and processed in United States dollars unless checkout expressly states otherwise.

Applicable taxes and shipping charges are calculated or displayed during checkout.

Prices, product offerings and availability may change without notice. If a material pricing error affects an order, we may contact you for instructions or cancel the affected order and issue a refund.

7. Payments

Payments are processed securely by Shopify and the payment providers available at checkout.

Exoticool does not receive or store complete payment-card numbers. By submitting payment information, you confirm that you are authorized to use the selected payment method and that the billing information is accurate.

Payment-provider terms and privacy practices may also apply to a transaction.

8. Production, Shipping and Delivery

Exoticool currently ships to eligible addresses within the United States.

Production generally takes 2–7 business days. Estimated U.S. carrier transit time is generally 3–7 business days, resulting in an estimated total delivery time of 5–14 business days.

Delivery dates are estimates and are not guarantees.

If we cannot ship an order within the stated production timeframe, we will notify the customer and provide the option to accept the delay or cancel the unshipped order for a full refund.

9. Cancellations, Returns and Refunds

Cancellation or modification requests must be submitted within 24 hours of purchase and can be approved only if the order has not entered production.

We do not accept returns, exchanges or refunds for changes of mind, buyer’s remorse, incorrectly selected sizes or colors, accidental orders after production begins or personal style preferences.

Damaged, defective, misprinted or incorrect items must be reported within 30 calendar days of delivery.

10. Product Availability and Collections

Product availability may change without notice.

Products described as limited editions or limited drops are available only under the conditions stated on the applicable product page. Collaborations and other products not identified as limited editions may remain available temporarily and may be retired at any time.

We do not guarantee that a retired or sold-out product will be restocked.

11. Intellectual Property

Unless otherwise stated, website content—including the Exoticool name, logos, original artwork, graphics, product designs, photographs and written content—is owned by Exoticool Merch LLC or used with permission from the applicable owner.

Collaborator names, likenesses, artwork and other third-party materials remain subject to the applicable ownership or permission arrangements.

You may not copy, reproduce, modify, distribute, manufacture, resell or commercially use protected Exoticool content without written permission from the applicable rights holder.

Purchasing a product does not transfer ownership of its artwork or intellectual-property rights.

12. Copyright Complaints

If you believe material displayed on Exoticool.com infringes your copyright, email support@exoticool.com with:

Your physical or electronic signature
Identification of the copyrighted work
Identification and location of the material you believe is infringing
Your name and contact information
A statement that you have a good-faith belief that the disputed use is unauthorized
A statement that the information in your notice is accurate and that you are authorized to act for the copyright owner

We may request additional information before acting on a complaint.

13. Prohibited Uses

You may not use our website or services to:

Violate applicable laws or the rights of another person.
Submit fraudulent orders or payment information.
Interfere with website operation or security.
Introduce malicious code or attempt unauthorized access.
Scrape, copy or reproduce protected content without authorization.
Impersonate another person or misrepresent your identity.
Use Exoticool content for unauthorized commercial purposes.

We may restrict access or cancel orders associated with prohibited activity.

14. Third-Party Services and Links

Our services rely on third parties including Shopify, payment providers, production partners, shipping carriers and technology providers.

Third-party websites and services are governed by their own terms and privacy policies. Exoticool does not control independent third-party websites linked from our store.

Nothing in this section limits Exoticool’s obligations to customers concerning orders, refunds, shipping or other rights that cannot legally be excluded.

15. Website Availability and Disclaimers

We make reasonable efforts to keep the website available and information accurate, but we do not guarantee uninterrupted or error-free access.

To the extent permitted by law, the website and services are provided without warranties beyond those expressly stated in these Terms, our policies or applicable law.

Nothing in these Terms excludes warranties, remedies or consumer rights that cannot legally be waived.

16. Limitation of Liability

To the fullest extent permitted by law, Exoticool Merch LLC will not be liable for indirect, incidental, special or consequential damages resulting from use of the website or services.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

17. Governing Law

These Terms are governed by the laws of the State of Oregon and applicable United States federal law, without regard to conflict-of-law principles.

Customers may also have rights under laws that apply where they reside and that cannot be waived by these Terms.

18. Severability and No Waiver

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect to the extent permitted by law.

A failure to enforce a provision does not waive the right to enforce it later.

19. Changes to These Terms

We may update these Terms when our products, services or legal obligations change.

The updated version will be posted on this page with a revised “Last Updated” date. Additional notice will be provided when required by applicable law.
